Mozilla & Goo Game Creator Challenge Official Rules

Introduction: The objective of this Mozilla & Goo Game Creator Challenge (the “Contest”) is to encourage development of creative new games and game scenes and characters for Firefox using Goo Create tools and the power of the Web.

Sponsors: The sponsors of this Contest are Mozilla Corporation, located at 650 Castro Street, Suite 300, Mountain View, CA 94041 and Goo Technologies AB, located at Linnégatan 89D 115 23, Stockholm, Sweden (“Sponsors”).

Eligibility: No purchase or fee is necessary to enter or claim any prize.

The Contest is open to individuals who are at least the age of majority in their country of residence, teams of individuals, educational institutions, organizations, and companies. Minors 13 years or older who reside in the U.S. and minors in certain other countries depending on local laws are also eligible to participate in the Contest but will be required to submit a signed parental consent form with their Entry. Email us at ecompton@mozilla.com for a parental consent form. Teams and entities must pick a team leader, who will submit the team's Entry and be the sole recipient of any prizes for the team (in other words there is only one prize per winning Entry, not a prize for each member of the team).

The Contest is void in any country subject to a U.S boycott and where prohibited by law or restricted by law or regulations.

Employees and contractors of Sponsors and their parent companies, subsidiaries, affiliates, suppliers, advertising agencies, and the families of and persons living in the same household as such employees, are not eligible to participate.

By entering you agree to be bound by these Official Rules and all decisions of the Sponsors and judges, which are final and binding. The Contest is subject to all applicable laws.

How to Enter: To enter the Contest, click the link from the Mozilla Blog or Goo Blog post to the Contest entry page. You will be asked to enter your name, email address, and contest category you are entering. An email will then be sent to you with further instruction on how to get started, including setting up a Goo Create account and where to access a quick-start tutorial to get you up and running. Create your game interactive scene or entire game level in accordance with the requirements described below (your “Entry”), and post it to a location of your choice. Send an email to mozgoocreate@mozilla.com that includes the URL where your Entry is posted, the category to which you are submitting your Entry, the name of your Entry and a brief description, and the name of the individual, team leader, or entity submitting the Entry. You may submit as many Entries as you wish.

If you are a team of individuals or an entity submitting an Entry, the Entry should be submitted under the email account of the team leader. All the individuals on the team or the name of the entity should be identified in some way in the description for proper attribution.

You must be the named and authorized account holder of the email address submitted in connection with your Entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider, or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Sponsors have no obligation to return or acknowledge Entries.

Without limiting any other rights, the Sponsors have the right to, in the Sponsors’ sole discretion, reject or remove from the Contest any Entry that, in the Sponsors’ sole discretion, violates these Rules, any applicable Sponsor policy, any applicable laws, or is in any way harmful or objectionable. Sponsors also reserve the right to disqualify any entrant or Entry at the Sponsors’ sole discretion. No correspondence shall be entered into.

Privacy: As part of the entry process the individual entrant or team leader will provide a name and email address. Winners will be asked to provide a mailing address so that we can send them their prizes. Except as otherwise stated herein or as otherwise agreed by you and the Sponsors, all personal information you provide in connection with the Contest will be used only for purposes relating to this Contest, and will not be communicated to third parties without prior permission or as otherwise specified in our Privacy Policies located at http://www.mozilla.org/en-US/privacy-policy.html and http://about.gootechnologies.com/legal/privacy.

Contest Period: The Contest begins at 7:00 a.m. Pacific Standard Time (PST) (15:00 GMT) on Thursday December 5, 2013 and ends at 11:59 p.m. PST on Tuesday, January 14, 2014 (7:59 GMT on January 15, 2014) (the “Contest Period”). No Entries will be accepted after the Contest closes.

Work Criteria: All Entries must meet specific criteria to be accepted into the Contest. Without limitation, the following conditions apply: (a) the Entry must be created using Goo Create and or Goo Engine; (b) the Entry must qualify for one of the judging categories described below, be submitted to the right category, and meet the category attributes described in these Rules and in the Contest information; (c) the Entry must be compatible with and function properly with the most recent general release version of Firefox for Desktop available at the start of the Contest and/or version 26 of Firefox for Android; (d) the description of the Entry included in your submission must be clear and accurate; (e) the Entry must be uploaded to a URL accessible to the Sponsors; (f) the Entry must be your original work and may not include any unauthorized intellectual property of a third party; (g) the name of your Entry may not include any Mozilla trademarks or portions thereof, except for the inclusion of “for Firefox” at the end of the name; (h) only amateurs who have never published a game before may submit Entries in the “Best Amateur Interactive Game Scene” category; (i) Entries in the “Best Amateur Interactive Game Scene” category must be created using only the creative elements available in the Goo Create asset library, known as primitives; (j) Entries in the “Best Amateur Interactive Game Scene” category must be released under an open source license following the Contest; and (k) Entries in the “Best Desktop Game” and “Best Mobile Game” categories must be created using JavaScript and open web technologies. The Entry must further comply with any additional technical requirements set forth in materials regarding the Contest.

In addition to the foregoing, Entries may not: (i) contain vulgar, offensive, obscene, lewd, or indecent language, behavior or imagery; (ii) defame, libel or otherwise violate the rights of any third party; (iii) violate or facilitate the violation of any federal, state or local laws or ordinances; (iv) target anyone because of his or her membership in a certain social group, including race, gender, color, religion, belief, sexual orientation, disability, ethnicity, nationality, age, gender identity, or political affiliation, or contain a symbolic representation of any group that targets anyone because of his or her membership in a certain social group; (v) contain any virus, spyware, malware, trap door, worm, or any other device, mechanism or code that is injurious or damaging to software or hardware used in conjunction with the Entry or results in overburden on the system; (vi) include content depicting sexual activity, nudity or excessively graphic violence; (vii) in any manner create, target or result in anything that in our sole discretion could damage, disable, overburden, or impair Sponsor’s systems or interfere with any other party’s Entries; or (viii) be disparaging or otherwise harm the reputation of the Sponsors as determined by the Sponsors in their sole discretion. Entries that are, in Sponsors’ sole opinion, inappropriate, inconsistent with Sponsors’ images, disparaging or otherwise not in compliance with these Official Rules, may be disqualified.

Sponsors reserve the right to remove an Entry from consideration by the judges if they, in their absolute discretion, to determine that it violates these Official Rules. Rejected Entries will not be acknowledged. Any Entries uploaded to a Sponsor controlled website and made available for viewing by the general public will be deemed posted at the direction of the entrant within the meaning of the Digital Millennium Copyright Act and the Communications Decency Act. Selection of Winners: After the Contest Period has ended, all Entries will be reviewed and judged by a panel of qualified judges using the criteria described below. The judges will select five winning Entries in the Best Amateur Interactive Game Scene category and one winner in each of the following categories: (a) Best Desktop Game, and (b) Best Mobile Game. Entrants select the category in which they want their Entry judged in their submission email.

Entries will be judged based on the following criteria, which will be equally weighted:

  • Best Amateur Interactive Game Scene
    • Visually stunning
    • Extent to which it is suggestive of an immersive game experience
    • Lighting and audio creativity
    • Originality
    • Entrant must be an amateur, first time game developer
  • Best Desktop Game
    • An immersive game experience for the desktop browser
    • A full game level
    • Creativity in visual design, audio, and character interactions
    • Technical mastery of web technologies
    • How well the game keeps player involved
  • Best Mobile Game
    • An immersive game experience for the mobile Web
    • A full game level
    • Creativity in visual design, audio, and character interactions
    • Technical mastery of Web technologies
    • How well the game keeps player involved
    • Bonus points will be awarded if the game also runs on Firefox OS
    • Entries tested on equivalent of Nexus 4 and Firefox for Android 26

The judges will also take into consideration whether the game is cross-platform, playable on both the desktop and mobile. The decisions of the judging panel are final on all matters relating to the Contest and no correspondence will be entered into.

Prizes:

Best Amateur Interactive Game Scene: The 5 winners will each receive (i) the equivalent of US$1,000 in the winner’s preferred currency, and (ii) one 5 year Goo Create Pro account (retail value US$2,900).

Best Desktop Game and Best Mobile Game: The winner of each of these categories will receive (i) at the winner’s option, either a trip for two people to the 2014 GDC Conference in San Francisco, California, scheduled for March 17 - 21, 2014 (maximum retail value $10,000) or a trip for two people to GamesCom Cologne in Cologne, Germany scheduled for August 13-17, 2014, (maximum retail value $10,000), or the equivalent of US$5,000 in the winner’s preferred currency; (ii) one 5 year Goo Create Pro account (retail value of US$2,900), (iii) a guest post on the Mozilla Apps Blog to explain the winning Entry, and (iv) promotion of the winning Entry on one or more Mozilla properties, the specifics of which will be announced at a future date.

The trip prize consists of roundtrip coach air travel for two people between a major airport nearest the winner’s home and either San Francisco, California or Cologne, Germany, or first class train travel if the winner lives within 100 miles of the destination city, 6 nights’ hotel accommodations at a moderately priced hotel, and entry to the chosen event. Should the total for airfare, hotel stay, and event entry fees exceed US$10,000, the winner will need to pay the difference. One of the Sponsors will work with the winner to make the travel arrangements. A major credit card will be required upon hotel check-in to cover any incidental expenses. The winners are responsible for possessing all necessary passports or other travel documents. Failure of a winner to be available or able to travel on the designated dates may result in forfeit of the prize.

If the winning Entry was created by a team or entity, only the team leader who submitted the Entry will receive the prize. A prize will not be given to each member of the team.

General Prize Conditions: The winners are solely responsible for the payment of any taxes that may arise as a result of acceptance of a prize, and all other expenses or costs relating to the prize not expressly set forth above. Prizes cannot be transferred or substituted and must be accepted as awarded. Sponsors reserve the right to substitute a prize of equal or greater value in its sole discretion. Please note that if the winning Entry was submitted by a team, only one prize will be awarded to the team. A prize will not be given to each member of the team.

Winner Notification/Validation: The winners will be notified by email on or about January 17, 2014. Each potential winner, and all team members if the winning Entry was submitted by a team, may be required to sign and return to Sponsors an affidavit of eligibility and liability/publicity release, where lawful, within five (5) days of the date of winning notification. If any winner is a minor under the laws of his/her place of residence, all documents must be signed by a parent or legal guardian. If a winner cannot be notified within five (5) days after his or her selection, or in the event of non-compliance with any of these requirements, the prize may be forfeited, and another Entry selected as a winner.

Authorization to Use Winner’s Entry Information & Name & Promotional Activity Participation: By entering, you agree that Sponsors and their designees may use your name, photo (to be provided by you), Entry, screen shots, and basic information about you and your Entry that you submit in any media now known or hereafter developed for promotional and/or publicity purposes, unless prohibited by law. You also agree to participate in and cooperate with any promotional activity and/or publicity relating to the Contest as the Sponsors shall reasonably request from time to time.

Release of Liability: By participating, you (meaning each member of a team if a team is submitting the Entry or the entity if an entity is submitting the Entry) release the Sponsors and their subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all others associated with the development and execution of this Contest, from and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Contest and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that these entities are in no way responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the Contest and/or the awarding of any prize except as may be expressly set forth in these Official Rules.

You also agree to hold harmless Sponsors, their officers, directors, employees, divisions, affiliates, subsidiaries, and advertising and promotional agencies, from any claim by any third party relating to any rights in the Entry you submitted.

Representations and Warranties: By entering, you (meaning each member of a team if a team is submitting the Entry or the entity if an entity is submitting the Entry) represent and warrant that (a) you are the sole and exclusive owner (and free of any adverse claim by any person, firm, or corporation) of all intellectual property rights in and to the Entry (exclusive of Mozilla’s intellectual property rights); (b) the Entry is original and the use of the Entry as described in these Rules will not infringe the proprietary rights, including without limitation the intellectual property rights, of any third party; (c) the use of the Entry, as described in these Rules, will be in compliance with any third-party licenses pertaining to the Entry; (d) the Entry is not obscene or libelous, and does not violate any rights of any third party, including but not limited to rights of privacy or publicity; (e) the Entry does not target anyone because of his or her membership in a certain social group, including race, gender, color, religion, belief, sexual orientation, disability, ethnicity, nationality, age, gender identity, or political affiliation, and does not contain a symbolic representation of any group that targets anyone because of his or her membership in a certain social group; (f) you have accurately categorized and described the type and nature of the Entry; (g) the Entry does not contain any virus, spyware, malware, trap door, worm, or any other device, mechanism or code that is injurious or damaging to software or hardware used in conjunction with the Entry; (h) the Entry and its use as described in these Rules will not violate any federal, provincial, state or local laws or ordinances; (i) the Entry is consistent with these Rules; and (j) you have the right to grant to Sponsors and their designees the license granted below. By entering you agree to be bound by these Official Rules, including all eligibility requirements and all decisions of Sponsors, which are final and binding in all matters relating to the Contest.

Intellectual Property: Your Entries shall remain your exclusive property. The code you write is yours. By participating in the Contest you specifically grant the Sponsors a worldwide, non-exclusive, fully paid-up, royalty-free, irrevocable and transferable license to publish, display etc. your Entries on any and all media now known or hereafter devised for any purposes (including marketing and promotional purposes) without further compensation to you or anyone else.

Sponsors’ Trademarks: The names Mozilla and Firefox, as well as the Mozilla logo, Firefox logo, and the red lizard logo are all registered trademarks of the Mozilla Foundation in the U.S. and several other countries. Any use of those or any other Mozilla trademark, trade name or logo must comply with the Mozilla Trademark Policies as posted at http://www.mozilla.org/foundation/trademarks/. The name Goo Create, as well as the Goo logo, are registered trademarks of Goo Technologies AB in several countries. Any use of those or any other Goo trademark, trade name or logo must comply with Goo Trademark Policies.

Disclaimers: Sponsors are not responsible for: (i) lost, late, misdirected, damaged, garbled or illegible entries; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsors on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Contest. Sponsors reserve the right to: (i) permanently disqualify from any Contest either sponsors any person it believes has intentionally violated these Official Rules; and (ii) suspend, modify or terminate the Contest if Sponsors believe, in their sole discretion, that malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, or integrity of the Contest. If the Contest is terminated before the scheduled end of the Contest Period, the Sponsors will determine the winners from all eligible entries received as of the termination date in a fair and equitable manner as determined by Sponsors in their reasonable discretion. Persons found tampering with or abusing any aspect of the Contest, or whom the Sponsors believe to be causing or attempting or intending to cause any malfunction, error, disruption, or damage will be disqualified. The Sponsors reserve the right to disqualify any unauthorized entries.

Disputes: These Official Rules and any disputes relating in any way to the Contest shall be governed exclusively by the laws of the State of California, USA, without regard to principles of conflicts of laws. By participating, you further agree that: (i) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney’s fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
