Welcome to the Argentina Legal Regulations page! Here you can find a list of all legal questions that our team has for this region, as well as ways to get involved as a legal localizer.

Questions

Privacy
  • Briefly describe any specific rules on data privacy, user consent, user rights to data, etc.
  • Do data controllers have any registration obligations in the country?
  • What are the liability rules for data privacy?
  • Are there any restrictions for hosting personal data overseas?
  • Are there any specific rules in connection with geolocation data or mobile phone data?
  • Are there any specific rules in connection with data collection of children? For example, in the US, websites cannot collect personal information of children under 13 without their parents consent
Games
  • Do digital games have to be rated?
  • If there is an age rating system, how does it work? Is there a specific place that the rating must be displayed? Are there regulations on this or just best practices?
  • What are the penalties for not displaying/classifying the correct rating?
Payment
  • What, if any, are the regulatory requirements for mobile billing and online app store purchases? "Online app store" examples are Google Play, Apple App Store, Amazon App Store, etc. The only items sold are apps, games, ringtones, etc. (referred to here as "Digital Content")
  • If possible to summarize in a few sentences, what are the taxes added to digital apps and games (e.g. it depends on what state the consumer is in, or it is always 17% flat, etc.)
  • Are there specific refund rules that apply to the purchase of Digital Content?
  • Is it necessary to have a local entity receive online payments?
  • If a local entity must receive online payments, are there specific rules on how the money can be transmitted out of the country to an international seller?
Intellectual Property
  • Can online search engines display trademarks from other companies?
  • Is there any regulatory framework to protect internet service providers from liability against claims of copyright or trademark infringement?
Content
  • What content, if any, is prohibited online and what are the rules? For example: adult content, gambling, speech against the government, depictions of religious leaders, etc.
  • How are the content restrictions enforced and what are the penalties?
  • Are there restrictions on the type of content that may be available to minors?
General
  • Are smartphones popular?
  • Is downloading free content on mobile phones popular?
  • Is downloading paid content on mobile phones popular?
