In order to be effective, open and interoperable, a technical framework and standards would be needed on transfer of receipts/licenses/terms-of-use to the new owner - especially between different systems.  Given that such standards do not exist today, premature legislation in this area which mandated the ability to resell might be unimplementable. A legal framework which did not include a mandate (but perhaps said "if you resell, then you must...") would be a good first step, as long as it encouraged or did not obstruct open and interoperable technical solutions.
